PRODUCT BOUNDARY
Route 420 is a travel, discovery and map platform. A Route 420 business listing or pin is a separate product from Rolling Stoner Authenticated media services and from any future RSTT tour, flight, accommodation or travel booking. No Route 420 listing purchase creates a right to magazine, photography, video, social-media or travel-booking services unless a separate written order expressly includes them.

1. Parties and scope

1.1These Terms govern access to and use of the Route 420 website, map, member accounts, business listings, partner profiles, Smoke Signals interfaces, route tools and itinerary tools operated by Rolling Stoner Travel and Tours (Pty) Ltd ("RSTT", "Route 420", "we", "us" or "the Operator").

1.2RSTT is registered in South Africa under registration number 2025/700740/07. Rolling Stoner media, editorial, advertising and the Authenticated programme are provided separately by Rolling Stoner (Pty) Ltd, registration number 2024/450808/07, unless an order expressly states otherwise.

1.3These Terms incorporate the Route 420 Privacy / POPIA Notice, Payment, Cancellation & Refund Policy and, where applicable, the Smoke Signals Posting, Moderation & Social Sharing Terms. A separate written partner order or signed agreement may add service-specific terms. If there is a conflict, the specific written order prevails for that paid service, subject to non-waivable law.

1.4These Terms do not govern the purchase of tours, flights, accommodation, transport, activities or other travel services. Those services require separate RSTT booking terms and, where relevant, third-party supplier or ticketing terms.

2. Eligibility, 18+ requirement and accounts

2.1You must be 18 years or older and legally capable of entering into a contract to create an interactive Route 420 account, manage a business listing, submit a Smoke Signal or access adult cannabis-related content.

2.2You must provide accurate account information and keep your password confidential. You are responsible for activity through your account until you notify us of suspected compromise.

2.3Email or account verification confirms control of the supplied contact channel. It is not a government identity check, criminal check, legal-compliance certification or licence verification unless Route 420 expressly states that a separate verification step has been completed.

2.4You may not impersonate another person or business, create misleading profiles, manipulate reviews or ranking, scrape the platform, bypass access controls, introduce harmful code, or use the platform for unlawful activity.

3. Nature of Route 420 and cannabis-law boundary

IMPORTANT CANNABIS-LAW NOTICE
Route 420 does not sell cannabis, act as a cannabis marketplace, broker or arrange cannabis sales, transport cannabis for users, or authorise public consumption. A business being listed, featured, badged, described as a partner, or appearing on a route does not mean that government has licensed or approved the business to sell or supply cannabis.

3.1Route 420 is a discovery, tourism, mapping, media-adjacent and community platform. It may feature lawful adult-oriented cannabis culture, education and destinations, but it must not be used to facilitate unlawful dealing, sale, supply, delivery or distribution of cannabis or regulated products.

3.2You may not use a listing, profile, promotion, event entry, message, link or other Route 420 feature to advertise or facilitate unlawful cannabis sales, publish menus or prices for unlawful THC products, offer delivery, direct users to "DM to buy", bundle cannabis into tourism or admission fees, or disguise a sale as a donation, gift, membership or other mechanism.

3.3Route 420 does not permit content encouraging cannabis use in public, in the presence of children, or in the presence of non-consenting adults. It does not permit content encouraging driving while impaired or carrying out dangerous activities while intoxicated.

3.4Medicinal, therapeutic or health-product claims must comply with applicable law and may be removed unless the business can support the claim and any required regulatory status. Route 420 is not a medical service and does not provide medical advice.

3.5Users and businesses remain solely responsible for understanding and complying with current South African law, venue rules, landowner rules, municipal by-laws and any licence, permit or regulatory conditions applicable to their activities.

4. Business listings, plans and product descriptions

4.1Route 420 may offer free, recurring or once-off listing plans. The current plan name, price, billing frequency, included features and any add-ons are shown in the checkout or written order and form part of your agreement.

4.2As at the draft date, the public checkout displays a free standard listing and a paid monthly featured listing. Route 420 may introduce, rename or withdraw plans, including annual plans or premium tiers, provided existing paid commitments are handled in accordance with these Terms and applicable law.

4.3A paid listing may include only the features stated at checkout or in the written order, such as featured directory placement, logo, description, cover image, gallery, contact details and social links. Search position, enquiries, footfall, sales, bookings, media coverage or commercial results are not guaranteed.

4.4A free listing does not create a right to premium visibility, editorial coverage, customer support beyond standard platform support, or future free access to features that later become paid.

4.5Rolling Stoner Authenticated media services, magazine advertising, editorial, photography, videography, PR, SEO and social-media production are separate services unless a separate Rolling Stoner order expressly includes them.

5. Subscription start, listing activation and onboarding

5.1For a paid plan, the "Subscription Start Date" is the date on which cleared payment is successfully confirmed by the payment processor or RSTT.

5.2The "Listing Activation Date" is the date on which the required listing information has been supplied, Route 420 has approved the listing, and the pin/profile is made live.

5.3Once all mandatory onboarding material is received, Route 420 will use reasonable efforts to approve the listing, reject it, or raise a query within five business days.

5.4The customer must provide accurate business details and all mandatory logos, images, descriptions, permissions and other onboarding material within 10 business days after payment or request. Route 420 may send reminders. If required material remains outstanding after 30 days, Route 420 may close or suspend the incomplete application.

5.5A delay caused by the customer does not pause, extend or restart the subscription term and does not, by itself, create a right to a refund. Route 420 will not scrape or copy third-party images or copyrighted material to complete a paid profile without appropriate rights or permission.

5.6Route 420 may reject a listing before activation if it is unlawful, materially misleading, unsafe, outside the platform scope, impossible to verify where verification is required, or presents unacceptable legal or reputational risk. If Route 420 rejects a paid application before providing the core service, the payment will be handled under the Refund Policy.

6. Listing content, accuracy and permissions

6.1You warrant that business names, contact information, trading descriptions, operating hours, locations, images, logos, social links and claims are accurate and that you have authority to provide them for publication.

6.2You grant RSTT a non-exclusive, royalty-free licence to host, reproduce, crop, resize, format and display the business material you provide for the purpose of operating and promoting your Route 420 listing and related Route 420 services during the term.

6.3You must promptly update information that becomes inaccurate, including closures, ownership changes, access conditions, licence or permit claims, health claims and contact details.

6.4Route 420 may correct obvious formatting issues, move a listing to a more appropriate category, reduce coordinate precision, add a warning, suspend a profile or request evidence where accuracy, safety or legal status is disputed.

7. "Authenticated", "verified", badges and trust language

7.1A Route 420 badge, feature, partner designation or listing status is a platform or media designation only. It is not a government licence, legal opinion, safety certificate, medicine registration, tourism grading, or guarantee of compliance.

7.2"Authenticated" is a separate Rolling Stoner programme with its own terms. A Route 420 listing does not automatically make a business Authenticated, and an Authenticated business does not automatically receive every Route 420 paid feature.

7.3Route 420 may remove or change a badge or status if the eligibility basis changes, information becomes unreliable, the partner breaches terms, or continued use creates legal, consumer or reputational risk.

8. Routes, maps, AI itinerary tools and third-party information

8.1Route 420 routes, map pins, directions, itinerary suggestions and AI-generated trip ideas are for discovery and planning assistance. They are not guaranteed travel advice, navigation, emergency guidance, legal advice or a confirmed booking.

8.2Conditions change. Before travel you must independently verify road access, opening hours, booking requirements, permissions, weather, safety, transport, accommodation, local rules and destination suitability.

8.3Third-party maps, websites, booking tools, social platforms and service providers may have their own terms. A link or map result does not make RSTT responsible for the third party or its products, services or conduct.

9. Fees, renewals, cancellation, suspension and non-payment

9.1Fees and billing frequency are displayed before checkout. Recurring plans renew automatically until cancelled, unless the order states otherwise.

9.2Monthly subscriptions may be cancelled at any time before the next billing event. Cancellation stops future renewal and normally takes effect at the end of the current paid billing period.

9.3If an annual prepaid plan is offered, cancellation normally stops the next renewal and service continues to the end of the paid term. Where the Consumer Protection Act or another law gives the customer a right to cancel earlier, that right and any lawful reasonable cancellation charge will apply.

9.4If a recurring payment fails, Route 420 may allow a seven-calendar-day grace period. If payment remains outstanding after the grace period, paid benefits and the public profile may be suspended until payment is resolved.

9.5After a paid term ends, Route 420 may unpublish the paid profile, downgrade it to a free/basic listing if that product exists and is suitable, or hold the profile in a non-public archive for a limited reactivation period.

9.6Refunds are governed by the separate Payment, Cancellation & Refund Policy, which is incorporated into these Terms.

10. Electronic contracting and immediate service commencement

10.1Before final checkout, the customer must be able to review the selected plan, price, recurring nature (if any), these Terms, the Privacy Notice and the Refund Policy, correct errors and withdraw before placing the order.

10.2Where permitted by law, a customer may request immediate commencement of onboarding and activation after payment. The checkout should record an explicit statement such as: "I request Route 420 to begin the onboarding and activation service immediately after successful payment."

10.3Nothing in these Terms removes a consumer right that cannot lawfully be excluded.

11. Marketing communications

11.1Acceptance of these Terms is not consent to receive optional direct marketing. Route 420 should use a separate, unticked marketing choice where consent is relied on for email, SMS, WhatsApp or similar direct marketing.

11.2Service messages needed to administer an account, payment, moderation, security or listing are not marketing and may be sent as necessary for the service.

11.3Marketing recipients may opt out through the method provided in the communication or by contacting the privacy/support channel.

12. Moderation, suspension and termination

12.1Route 420 may reject, edit for format, hide, suspend or remove a listing or account where reasonably necessary to enforce these Terms, address a complaint, protect safety, prevent unlawful conduct, protect rights or respond to a regulator or court.

12.2Serious matters may justify immediate suspension, including suspected unlawful dealing or product promotion, fraud, threats, harassment, impersonation, privacy breaches, IP infringement, dangerous content, child-related risk, or conduct likely to expose users or the platform to material harm.

12.3Where appropriate, Route 420 will give the account holder a reasonable opportunity to respond or cure the issue. Immediate action may be taken where delay could create harm or legal risk.

13. Intellectual property

13.1Route 420, Rolling Stoner names, logos, map design, software, databases, layouts, taxonomies, editorial material and other platform intellectual property belong to their respective owners or licensors. No ownership is transferred to users.

13.2You may use Route 420 badges, partner marks or supplied brand assets only for the authorised period, in the approved format and subject to applicable brand rules. The permission ends when the related status or agreement ends.

14. IMPORTANT - limitation of liability and assumption of risk

THIS CLAUSE LIMITS LIABILITY
To the fullest extent permitted by law, RSTT and the relevant Rolling Stoner parties do not guarantee platform uptime, map accuracy, listing accuracy, business legality, customer enquiries, revenue, route safety, third-party performance or the availability of a destination. Users remain responsible for independent checks before relying on a listing, route or third-party service. Nothing excludes liability that applicable law prohibits excluding, including liability for gross negligence or intentional misconduct where applicable.

14.1To the fullest extent permitted by law, neither RSTT nor the relevant Rolling Stoner parties will be liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of goodwill or loss arising from third-party conduct, except to the extent such limitation is prohibited by law.

14.2Where a consumer is entitled to statutory remedies or quality-of-service rights, those rights remain unaffected.

15. IMPORTANT - indemnity for customer-supplied content and unlawful conduct

YOU MAY HAVE TO REIMBURSE US
To the fullest extent permitted by law, you indemnify the Route 420 / Rolling Stoner parties against third-party claims, regulatory complaints, losses and reasonable legal costs to the extent caused by your unauthorised content, false claims, infringement, privacy breach, unlawful sales promotion, impersonation, or other breach of these Terms. This does not require you to indemnify a party for that party's gross negligence, intentional misconduct or liability that cannot lawfully be transferred.

16. Complaints, disputes and governing law

16.1Complaints about listings, privacy, unlawful content, IP or safety should be sent to the relevant contact in the legal notice section. Route 420 may require proof of identity, authority or supporting evidence.

16.2These Terms are governed by South African law. Before formal proceedings, the parties should give written notice and allow 10 business days for a good-faith attempt to resolve the dispute, except where urgent relief is required.

16.3Nothing prevents a consumer or data subject from approaching a competent court, the National Consumer Commission, Consumer Goods and Services Ombud, Information Regulator or another competent authority where permitted by law.

17. Changes to these Terms

17.1Route 420 may update these Terms to reflect legal, product, technical or risk changes. Material changes should be communicated through the platform or by another reasonable method. A user may be required to accept updated terms before a new purchase, renewal or submission.

17.2The platform should retain the version, date and evidence of the Terms accepted at checkout or account submission.
